General terms of use

Navigation on the site (hereafter the “Site”) is subject to the regulations in effect and these terms of use (Hereafter the “Terms of Use”).

The latter being updated regularly, you are encouraged to visit this page each time you connect to the Site as well as the legal notices section.

The documents, information and service offerings distributed on the site are intended for the consumer within the meaning of article 3 of the Hamon Law of March 17, 2014 (hereafter the “User”).

You are advised that anything you view and read on this site is protected by intellectual property rights.

In the event of a dispute between the User and their telecommunications operator or any other operator or intermediary, or in the event of malfunction of the computer or the form of access belonging to the User, the internet network and access to this network, regardless of the cause or source, AVRIL PA would not be liable, if this resulted in difficulties in User transmission and the sending of instructions within the normal time limits.


1. Acceptance of the General Terms of Use

These Terms of Use contractually govern the relations between AVRIL PA and the User.

The User acknowledges being aware of the following provisions before using the Site.

In the event of a contradiction between these Terms of Use and any other document appearing on the site, the latter will prevail.


2. External contributions

The Site offers areas of free expression for Users (News, Publication of documents, files, etc.). The information published in these areas is not subject to any monitoring by AVRIL PA and is published directly on the Site after the User has validated it. Consequently, only the author of the publications assumes publisher liability. AVRIL PA accepts no liability relating to the publication of information in these free expression areas.

The Users remain proprietors of the information that they communicate. AVRIL PA is released from any liability regarding false statements issued by a User and reserves the right of recourse against them in the event of false statements causing damage to them.

Consequently, and except for direct harm resulting from a grave or intentional error by AVRIL PA, the latter accepts no liability:

  • for any imprecision, inaccuracy or omission dealing with the information available on the Site;
  • for any harm resulting from a fraudulent breach by a third party, resulting in a modification of the information or items made available on the Site;
  • and more generally for any direct or indirect harm, regardless of the causes, sources, sorts or consequences, even if AVRIL PA had been informed of the possibility of such harm, caused by (i) the access by anyone to the Site or the inability to access it, (ii) the use of the Site, including any degradation or virus that may infect your computer equipment or any other property, and/or (iii) the credit granted to any information directly or indirectly originating from the Site.


3. Intellectual Property

The items appearing within this site, such as sounds, images, photographs, videos, publications, animations, programmes, graphic charts, utilities, databases, software, are protected by the provisions of the Intellectual Property Code and belong to AVRIL PA.

The User is prohibited from harming intellectual property rights pertaining to these items and notably by reproducing, modifying, adjusting, translating, removing them and/or reusing a qualitatively or quantitatively substantial portion, with the exception of necessary acts for their normal and intended use.


4. Change in management of AVRIL PA

The data collected by AVRIL PA may be subjected to a transfer to third parties within the framework of a change in management of AVRIL PA, an acquisition, a collective procedure or sale of the company’s assets.


5. Security

AVRIL PA’s computer systems are subjected to state of the art physical and software protection. Physical and electronic backup procedures of data collected on the Site were implemented, in accordance with French legislation in effect relating to personal data protection.

However, AVRIL PA does not manage the risks associated with the operation of the internet and draws your attention to the existence of potential risks in terms of temporary losses of data or breaches of confidentiality of data being routed through this network. The information offered on the Site may be disrupted due to cases of force majeure or independent from the desired actions of AVRIL PA or occurrences not falling under the responsibility of AVRIL PA.


6. Protection of personal data

AVRIL PA may potentially collect the User’s personal data, notably through the “contact” section or when subscribing to the electronic Newsletter offered by AVRIL PA.

AVRIL PA may be prompted to collect information by placing a cookie or a web beacon on the User’s computer. A cookie does not enable it to identify the User; on the other hand, it records information relating to the navigation of the User’s computer on the Site (the pages that you visited, the date and the time of the visit, etc.) that Avril PA may read upon subsequent visits of the User. AVRIL PA informs the User that they can decline the storage of “cookies” by configuring their browser.

The information collected is subjected to computer processing intended for the delivery of promotions or product information. The recipients of data are restaurant catering service professionals.

8. Applicable law and disputes

This document is subject to French law. In the event of dispute regarding its interpretation and/or execution, the court in RENNES will have sole jurisdiction.

The User and AVRIL PA will always give priority to an amicable solution before taking any legal action.

In virtue of articles 313-1 and following of the Criminal Code, a fraud is constituted by “the occurrence, either by use of a false name or a false attribute, or by the misuse of a true attribute, or by the use of fraudulent activities, in order to deceive a natural person or legal entity and to thus incite them, to their detriment or to the detriment of a third party, to send funds, securities or any asset, to provide a service or to agree to an act bringing about an obligation or discharge”.

The policy of the Site is to prosecute anyone deemed guilty of such attempted fraud.
